UV-328 will be restricted under POPs Regulation with specific exemptions of UTC.
On July 30, 2024, European Commission opened up a 4-week consultation which proposed to introduce 2-(2H-benzotriazol-2-yl)-4,6 di tert pentylphenol (UV-328) to Part A of Annex I with specific exemptions.
The draft delegated regulation is open for consultation until August 27, 2024. The amendment is proposed to take effect on February 26, 2025.
At the eleventh meeting of the Conference of the Parties to the Stockholm Convention, which took place in Geneva, Switzerland in May 2023, it was decided to include UV-328 in Annex A to the Convention with certain specific exemptions.
UV-328 is used as a UV stabilizer in plastic shrink films, outdoor furniture and clear coat automotive finishes as well as for light stabilization in coatings, acrylonitrile butadiene styrene resin, epoxy resin, fiber resin, polypropylene and polyvinyl chloride (PVC).
To reinforce the application and enforcement of Article 3(1)(b) of POPs Regulation in the EU, a limit value is set for UV-328 occurring as an unintentional trace contaminant (UTC) in substances, mixtures and articles. Exemptions are also provided for certain essential applications. The details are shown below:
