U.S. FDA Declares 35 PFAS Food Contact Notifications Ineffective

On January 3, 2025, the U.S. Food and Drug Administration (FDA) issued a notice concerning Food Contact Notifications (FCNs) that are no longer effective. In this notice, the FDA announced that 35 FCNs related to per- and polyfluoroalkyl substances (PFAS) have been deemed ineffective. This decision follows notifications from manufacturers indicating that they have discontinued the production, supply, or use of the specified food contact substances (FCSs) in the United States. These substances were previously utilized as grease-proofing agents in coatings applied to paper and paperboard packaging to prevent oil and water leakage.

The determination regarding the FCNs listed in Table 1 and Table 2 will take effect on January 6, 2025. For FCSs listed in Table 2 that were produced, supplied, or used prior to the effective date, manufacturers must ensure compliance by June 30, 2025.
