Two toxic substances are officially listed in Canada under the Environmental Protection Act.

The Government of Canada formally added two high-concern chemical chemicals to Part 1, Schedule 1 of the Canadian Environmental Protection Act, 1999 (CEPA) (List of Toxic chemicals) on February 14, 2025, in accordance with Section 90(1) of the Act. In order to reduce the hazards to the environment and public health, this regulatory measure seeks to limit their import, use, and manufacturing.

Newly Listed Toxic Substances

Scientific Basis

The persistence, bioaccumulation potential, and toxicity (PBT characteristics) of these compounds are confirmed by joint evaluations conducted by Environment and Climate Change Canada (ECCC) and Health Canada. These substances have the potential to build up through food systems, endangering both human and wildlife populations. 

Compliance Requirements

Effective immediately upon registration (February 14, 2025):

  1. CEPA Sections 64 to 99 must be followed in the commercial production, importation, and use of various substances, including:
  • Mandatory risk assessments
  • Substitution plan submissions
  • Emission control protocols
  1. For disposal or restricted exemptions, entities with existing inventories must apply specifically to the ECCC.
