Starting 1 March 2025, EU exporters must notify their intention to export 40 additional hazardous chemicals, following the European Commission’s recent decision to expand the EU’s Prior Informed Consent (PIC) Regulation.
The latest update adds 40 chemicals to Annex I of the PIC Regulation, comprising 35 pesticides and five industrial chemicals. These include substances such as abamectin, difenacoum, fenpropimorph, dimethomorph, triadimenol, and penflufen.
Chemicals listed in Part 1 of Annex I require export notification to ECHA before shipments can begin. Furthermore, 38 of the newly added substances are included in both Part 1 and Part 2 of Annex I, meaning they also require explicit consent from the importing country before export.
Additionally, the status of two chemicals—cyanamide and warfarin—already listed in Annex I has been updated. Once the amendment takes effect, their export will require explicit consent alongside export notification.
A subgroup of PFAS, including perfluorohexane sulfonic acid (PFHxS), its salts, and related compounds, has been added to Annex V of the PIC Regulation, which bans the export of these chemicals. This update aligns with their classification as persistent organic pollutants under the Stockholm Convention.
ECHA’s IT tool, ePIC, has been updated to reflect these changes, and companies can now submit notifications for the export of these chemicals.
Background
The PIC Regulation regulates the trade of hazardous chemicals that are banned or heavily restricted in the EU. It imposes obligations on companies exporting these chemicals to non-EU countries or importing them into the EU.
Annex I of the regulation is updated annually by the European Commission. It now includes 321 entries subject to export notification and, in many cases, explicit consent requirements.
