CALIFORNIA – Proposed Priority Product: Motor Vehicle Tires Containing 6PPD

Motor vehicle tyres containing N-(1,3-dimethylbutyl)-N′-phenyl-p-phenylenediamine (6PPD) have been listed as a new Priority Product by the California Department of Toxic Substances Control (DTSC) in accordance with the Safer Consumer Products (SCP) Regulations.

This regulation is set to take effect on October 1, 2023.

Priority Product Notifications (PPNs) for motor vehicle tyres (as defined in the law) that contain 6PPD and whose goods are introduced into the California stream of commerce must
be submitted by November 30, 2023.

Manufacturers may choose to submit one of the following through CalSAFER after submitting the PPN by March 29, 2024:
a. Chemical Removal Intent/Confirmation Notification,
b. Product Removal Intent/Confirmation Notification,
c. Product-Chemical Replacement Intent/Confirmation Notification, or
d. Preliminary Alternatives Analysis Report or these alternate reporting options.

Manufacturers have the initial obligation to comply, but if a manufacturer doesn’t, DTSC may notify importers or sellers that they too have a duty to do so.

It is not necessary for tyre producers for motor vehicles to take any action if their goods do not include 6PPD.
