New York Proposes Mandatory GHG Reporting for Major Emitters

New York State’s Department of Environmental Conservation (DEC) has released draft regulations proposing mandatory greenhouse gas (GHG) emissions reporting for significant emitters, with reporting set to begin in 2027 for the previous year’s data.

Key Points of the Proposal:

  • Targeted Entities: The regulation would require annual GHG emissions reporting from entities such as:

    • Electric power entities, including electricity generation and stationary combustion facilities.

    • Landfills, waste-to-energy plants, and natural gas compressor stations.

    • Fuel suppliers, waste haulers, and entities like fertilizer suppliers and anaerobic digesters that exceed 10,000 metric tons of CO2e annually.

  • Exemption from Emission Reduction Requirements: The draft proposal does not impose mandates on facilities to reduce emissions or acquire emission allowances. However, it serves as a critical step in New York’s cap-and-invest program, which requires large emitters to purchase allowances to cover emissions beyond an annually declining cap.

  • Cap-and-Invest Program:

    • Unveiled by Governor Kathy Hochul in 2023, the program will generate over $1 billion annually, which will be used to fund emissions reduction initiatives and support vulnerable communities facing rising energy costs.

    • The program’s trajectory aligns with New York’s Climate Act, with the emissions cap set to decrease each year.

To ease compliance, the DEC will offer:

  • Online platforms for reporting, along with training once it launches.

  • A simplified estimator tool to help entities like fuel suppliers determine if they meet reporting thresholds.

  • Utilization of existing data from state and federal programs to minimize costs for reporting entities.

The public comment period for these regulations will run through July 1, 2025.
