Taiwan adds PFC testing criteria to its water pollution control regulation

The Taiwanese Ministry published the revision to the “Water pollution control measures and test reporting management regulations” on January 20, 2025. In addition to strengthening the management of PFCs (PFOS, PFOA, PFHxS, etc.), the amendment included a clause mandating that specified enterprises do yearly PFC testing and reporting. Furthermore, a clause exempting testing of reclaimed water from reporting obligations has been inserted. With the exception of certain articles, such the PFC management provisions, which have a different effective date, the amendment takes effect on the date of promulgation. 

Requirements for PFCS

A clause mandating specified firms to do yearly testing and reporting of target compounds has been introduced to Article 84-3 in order to improve the management of PFCs (perfluorinated chemicals) and other substances. The company is required to provide the authorities with a voluntary reduction management plan within three months if the aforementioned test yields two consecutive results that are higher than the discharge values listed in Table 6. Nonetheless, the firm is exempt from reporting the testing for that test item if the test yields three or more consecutive tests that fall below the discharge levels shown in Table 6. An excerpt from Table 6, which lists the covered firms and testing frequency, is included in the table below.

※The effective date of the amendment has been delayed one year from the date specified in the draft, which was January 1, 2026.

Addition of provisions regarding exemption from reporting inspections of recovered water

Article 79 has been amended to exempt companies from reporting water quality and quantity inspections when wastewater (effluent) is recovered and used in manufacturing processes, washing towers, or other pollution prevention equipment, following treatment in a wastewater (effluent) treatment facility.

Additionally, the amendment adds a new clause mandating that the best available control technology, like anaerobic treatment, be implemented first in industries like paper manufacturing and petrochemicals where the chemical oxygen demand concentration is 2,000 mg/L or higher and the permitted wastewater volume per day is 1,000 m3 or more, or where the chemical oxygen demand load per day is 2 tons or more.
