Vietnam’s Extended Producer Responsibility (EPR) requirements are governed by the Environmental Protection Law and its supporting regulations, including Decree No. 08/2022/ND-CP, which details various provisions of the law. On January 6, 2025, Vietnam introduced Decree 05/2025/ND-CP, revising Decree No. 08/2022/ND-CP to specifically enhance EPR requirements for packaging. This new Decree takes effect immediately upon issuance.
Key Updates
- Changes to Exemptions for Waste Recycling and Treatment Obligations
Previously, the exemption thresholds for packaging producers and importers differed. Decree 05/2025/ND-CP standardizes the exemption limit to 30 billion VND annually for both producers and importers.
Additionally, the Decree introduces a new exemption for manufacturers whose packaging is collected and repackaged for reintroduction into the market, provided that the collection and repackaging rate meets or exceeds the mandatory recycling rate outlined in Column 4 of Appendix XXII of this Decree.
2. Updates to Mandatory Recycling Specifications
Appendix XXII, which outlines the mandatory recycling rates and specifications for packaging, has been revised primarily to update the recycling specifications. However, the mandatory recycling rates for various packaging materials remain unchanged. The updates are highlighted in red within the table provided.
