To further limit the possible risks of dangerous chemicals to the environment and human health, the European Commission formally adopted two modifications to Annex I of Regulation (EU) 2019/1021, the POPs Regulation, on May 5, 2025. The revisions primarily address the UV-328 ultraviolet absorber control regulations and the exemption period for firefighting foams containing perfluorooctanoic acid (PFOA), its salts, and similar substances.

Control provisions for UV-328

The European Commission added the following entry to Part A of Annex I to Regulation (EU) 2019/1021:

Core amendments to PFOA and its salts and related compounds

1. Specific fire-fighting foam exemption period adjustment:

• Regarding current firefighting foams that contain chemicals related to PFOA or their mixtures: In installed firefighting foam systems used to suppress liquid fuel vapors (Class B fires), residual PFOA-related substances or their mixtures cannot be more than 10 mg/kg (0.001% by weight). The exception will remain in effect for three years after the new regulations go into effect; the precise expiration date will be decided upon following official publication.

• For fluorine-free firefighting foam cleaning standards: Equipment cleaned with “Best Available Techniques” is exempt from utilizing fluorine-free firefighting foams if residual PFOA-related compounds or their mixtures surpass the 10 mg/kg level.

2. Extension of exemption period:The specific exemption period for PFOA and its salts and related compounds in fire-fighting foams is extended from 4 July 2025 to 3 December 2025.

3. Deletion of review clause: The review clause requiring a review of the UTC (Unintentional Trace Contamination) limits for PFOA, its salts and PFOA-related compounds has been deleted.

4. New industrial transition clause:Products that were already available on the EU market prior to the expiration of the current exemption clauses (Articles 5(a)-(d)) and contained PFOA, its salts, and similar chemicals may be used until the end of their useful lives.
   Twenty days after it is published in the EU Official Journal, the amendment will become operative. Prompt supply chain reviews and steps to reduce compliance risks should be taken by pertinent businesses.
