From 1 March 2025, EU exporters must notify their intent to export 40 additional hazardous chemicals. This follows the European Commission’s recent decision to expand the list of chemicals under the EU’s Prior Informed Consent (PIC) Regulation. The new additions to Annex I of PIC include 35 pesticides and five industrial chemicals, such as abamectin, difenacoum, fenpropimorph, dimethomorph, triadimenol, and penflufen.
Inclusion in Annex I requires companies to notify the European Chemicals Agency (ECHA) before exporting these chemicals (for substances listed in Part 1 of Annex I). Additionally, 38 of the newly added substances require explicit consent from importing countries before export, as they appear in both Parts 1 and 2 of Annex I. Updates have also been made to the export requirements for cyanamide and warfarin, which will now require explicit consent in addition to notification.
Furthermore, perfluorohexane sulfonic acid (PFHxS), its salts, and related compounds—a subgroup of PFAS—are now included in Annex V of PIC, which prohibits their export. This aligns with their classification as persistent organic pollutants under the Stockholm Convention.
ECHA’s IT platform, ePIC, has been updated to accommodate these changes, allowing companies to submit the necessary export notifications for the affected chemicals.
Background
The PIC Regulation governs the trade of hazardous chemicals that are banned or heavily restricted within the EU. It requires companies exporting these chemicals to non-EU countries or importing them into the EU to meet specific obligations. Annex I of the PIC Regulation is updated annually by the European Commission and now lists 321 chemicals.
