On April 7th of 2023, Office of Environmental Health Hazard Assessment (OEHHA) Proposed to amend the No Significant Risk Level (NSRL) for ethylene oxide to 0.058 micrograms per day from existing 2 micrograms per day.
Ethylene oxide is listed in prop 65 as it is Carcenogenic and reproductive toxic.
On May 11th , OEHHA extended the consultation period to 14th June instaed of previous proposed timeline of 23rd May 2023 . This allows the affected parties to review and comment on the potential impact .
In case of implementation of new NSRL, impacts producers using ethylene oxide. Such business should notify Californians about exposure of Ethylene oxide has to notify thorugh Prop 65 warnings.
Penalties for violating Proposition 65 by failing to provide warnings can be as high as $2,500 per violation per day.
